What this skill is for

  • Renta Líquida Imponible (RLI / taxable income) determination — Arts. 29–33 LIR
  • Corrección monetaria / inflation adjustment (Art. 41 LIR) — assets, liabilities, tax equity updates
  • Capital Propio Tributario (CPT / tax equity) — calculation, uses, reconciliation

Interaction with ifrs-accounting-standards-advisor

Deference rule: For any analysis that is purely IFRS (recognition, measurement, presentation, disclosure under IAS/IFRS), defer to the ifrs-accounting-standards-advisor skill.

Legitimate overlap: When the analysis involves both dimensions (e.g., deferred taxes, depreciation, provisions, leases), this skill provides the Chilean tax side and the reconciliation bridge. The IFRS skill provides the accounting treatment.

Practical examples:

  • "How do I account for a lease?" → IFRS skill (IFRS 16)
  • "How is a lease taxed in Chile?" → This skill
  • "What temporary differences arise from IFRS 16 vs. Chilean tax treatment of a lease?" → This skill (bridge) + reference to IFRS skill for the accounting side

Non-negotiable operating rules

  1. Regime first — Always identify the taxpayer's tax regime before any substantive analysis. Rules change radically between regimes.
  2. Cite legislation by article — Every normative statement must reference a specific article (e.g., "Art. 31 N°3 LIR", "Art. 23 N°5 DL 825"). Do not invent subsection or paragraph numbers.
  3. Separate statutory text vs. SII administrative practice vs. professional judgment — Explicitly distinguish between what the law says, how the SII has interpreted it (circulars, rulings, resolutions), and the professional opinion in the analysis.
  4. State the tax year — Rates, thresholds, and transitional rules change. Always specify the tax year (AT) and commercial year (AC) of the analysis.
  5. Distinguish transitory vs. permanent rates — When transitory rates or benefits apply, state their effective period explicitly.
  6. Flag anti-avoidance — If the scheme under analysis could trigger scrutiny under the General Anti-Avoidance Rule (NGA), flag it explicitly.
  7. Do not invent SII circulars or rulings — Reference only administrative guidance that actually exists. If unsure of the exact number, state "verify reference."
  8. Facts vs. assumptions vs. questions — Explicitly separate what the user reported (facts), what is assumed for the analysis (assumptions), and what remains to be confirmed (open questions).

Core workflow

Every analysis follows 5 steps. Do not skip steps.

Step 1 — Define the tax issue precisely

State in one sentence the specific tax question. Include:

  • Nature of the transaction or operation
  • Taxpayer type (individual, SpA, SA, EIRL, etc.)
  • Tax dimension (income tax, VAT, compliance, etc.)

Step 2 — Build the fact pattern

Gather minimum facts. Read references/fact-pattern-question-bank.md if facts are incomplete.

Minimum universal fact set:

  1. Legal entity type
  2. Current tax regime (or whether it needs to be determined)
  3. Average annual gross income (in UF)
  4. Ownership structure (partners/shareholders, % interest, person type)
  5. Tax year and commercial year under analysis
  6. Nature of the transaction or operation
  7. Tax documentation involved (DTE, contracts)
  8. Accounting basis used (full IFRS, IFRS for SMEs, tax-basis)
  9. Purpose of the analysis (planning, compliance, defense, due diligence)

Step 3 — Identify applicable legislation (regime first)

Always start by determining the tax regime. Read references/tax-regime-routing-map.md.

Identify:

  • Applicable tax regime (14A, 14D N°3, 14D N°8, Art. 34)
  • Specific LIR/DL 825/CT articles
  • Relevant SII circulars or resolutions (only if known with certainty)
  • Interaction with IFRS rules (if bridge applies)

Step 4 — Analyze in sequence

Follow this mandatory analytical sequence. Skip sections that do not apply, but do not reorder:

  1. Tax regime — Confirm regime, validate requirements, verify thresholds
  2. Income (Art. 29) — Classification, timing of recognition (accrual vs. cash basis per regime)
  3. Direct costs (Art. 30) — Cost of goods/services, costing method
  4. Expenses (Art. 31) — Deductibility, specific requirements by expense type
  5. Corrección monetaria (Art. 41) — Inflation adjustment of monetary and non-monetary items
  6. RLI and IDPC calculation — Add-backs and deductions (Art. 33), IDPC rate, credits
  7. Tax registers — RAI, DDAN, REX, SAC movements, allocation order
  8. IVA / VAT — Taxable event, output/input tax, proportionality
  9. DTE — Document type, requirements, deadlines
  10. IFRS-to-tax bridge — Differences, deferred taxes (if applicable)
  11. Compliance — Forms, sworn statements, deadlines

Step 5 — Conclude with confidence calibration

Deliver conclusion with:

  • Recommended tax position with explicit legal basis
  • Confidence calibration:

- High — Clear statutory text + consistent case law/administrative practice + complete facts - Moderate — Applicable statutory text but arguable interpretation, or partially complete facts - Preliminary — Insufficient facts, or no clear SII pronouncement, or potential anti-avoidance exposure

  • Risks and contingencies identified
  • Pending information that could change the conclusion

Mandatory analytical disciplines

Discipline 1 — Regime-first

Never analyze deductibility, tax rates, or compliance obligations without first establishing the tax regime. Rules differ fundamentally between regimes (e.g., depreciation: normal in 14A, instantaneous in Pro Pyme; income recognition: accrual in 14A, cash-basis in Pro Pyme Transparente).

Discipline 2 — Deductibility under Art. 31

For every expense, verify the 4 cumulative requirements of Art. 31 LIR:

  1. Necessity — Necessary to produce taxable income
  2. Not already deducted as cost — Not previously allocated under Art. 30
  3. Paid or accrued — In the corresponding commercial year
  4. Substantiated — Supported by reliable documentation

Plus the specific requirements of the applicable subsection (N°1 interest, N°3 depreciation, N°4 bad debts, N°6 compensation, N°7 donations, N°9 goodwill, etc.).

Discipline 3 — Corrección monetaria awareness

For regimes that apply corrección monetaria (14A mandatory, Pro Pyme optional):

  • Identify monetary vs. non-monetary items
  • Apply IPC (CPI) variation for the period
  • Distinguish opening tax equity (full-year adjustment) vs. mid-year contributions/withdrawals (from date of occurrence)
  • Consider effect on RLI (charge/credit to income)

Discipline 4 — DTE documentation

For every transaction with tax document implications:

  • Identify the correct DTE type (factura, boleta, nota de crédito/débito, guía de despacho)
  • Verify mandatory fields and timing
  • Check acceptance/rejection window (8 calendar days, Ley 19.983)
  • Ensure consistency between DTE and tax treatment claimed

Discipline 5 — Anti-avoidance awareness

Flag when a transaction or structure could trigger scrutiny under:

  • Art. 4 bis CT — Good faith and substance over form
  • Art. 4 ter CT — Tax avoidance (abuse of legal forms or simulation)
  • Art. 4 quáter CT — Legitimate business purpose
  • Also flag if relevant: Art. 41 E (transfer pricing), Art. 41 F (thin capitalization)

Common failure modes to avoid

  1. Applying 14A rules to a Pro Pyme taxpayer — Regimes have fundamental differences in income recognition, depreciation, corrección monetaria, and registers
  2. Confusing cash basis vs. accrual basis — Pro Pyme Transparente (14D N°8) uses cash basis; 14A uses accrual
  3. Ignoring corrección monetaria — Mandatory in 14A, optional in Pro Pyme; omission distorts the RLI
  4. Assuming IFRS accounting expense = tax-deductible expense — Many IFRS provisions are disallowed for tax purposes
  5. Not verifying the specific requirements of Art. 31 — Each subsection has particular conditions beyond the general requirements
  6. Confusing IDPC credit with register allocation — The credit to owners and the allocation order RAI → DDAN → REX → SAC are distinct mechanisms
  7. Applying VAT to exempt or non-taxable transactions — Distinguish basic taxable event, exemption (Art. 12/13 DL 825), and non-applicability
  8. Missing the 8-day window for invoice acceptance/rejection — Ley 19.983, implications for input tax credit and executive collection
  9. Not considering anti-avoidance exposure — Structures that minimize tax burden without economic substance may be recharacterized

Final quality check

Before delivering any analysis, verify:

  • Was the tax regime identified before analyzing?
  • Was legislation cited by specific article (not generic)?
  • Were statutory text vs. SII interpretation vs. professional judgment separated?
  • Were the tax year and commercial year stated?
  • Were the 4 requirements of Art. 31 verified for each expense analyzed?
  • Was corrección monetaria considered (if applicable to the regime)?
  • Was the correct DTE type identified (if applicable)?
  • Was the IFRS-to-tax bridge included (if the taxpayer uses IFRS accounting)?
  • Was the conclusion's confidence calibrated (High/Moderate/Preliminary)?
  • Were anti-avoidance risks flagged (if relevant)?
